1. SCOPE

1.1.

These Specific Online Gaming Conditions of Use (hereinafter the “Online Gaming Conditions”) govern the content and operation of the lotoquebec.com web site as well as any application and site of Loto-Québec or one of its subsidiaries and made available on a mobile device such as a smart phone or a tablet computer (hereinafter a “Mobile device”) (all of which to be designated hereinafter as the “Site”) as well as the authorized use that each person using the Site (hereinafter a “Client”) may make of it.

The Online Gaming Conditions are in addition to the General Conditions Governing the Use of the Internet Sites Operated by Loto-Québec and its Subsidiaries (hereinafter the “Loto-Québec General Conditions”), which also apply to the content, operation and use of the Site.


1.2.

In the event of a discrepancy between a condition stated in the Loto-Québec General Conditions and a condition stated in the Online Gaming Conditions herein, the latter shall prevail.


1.3.

Unless otherwise indicated, the terms as defined in the Loto-Québec General Conditions shall have, when used in the Online Gaming Conditions herein, the same meaning as given in the Loto-Québec General Conditions.


1.4.

Each Client agrees that these Online Gaming Conditions may be modified by Loto-Québec at any time and without prior notice and to be bound by such modifications. Therefore, it is recommended that the Client consult the Online Gaming Conditions regularly in order to remain apprised of the latest Online Gaming Conditions in effect.


1.5.

Loto-Québec’s Privacy Policy also applies to these Online Game Conditions and forms an integral part thereof.


2. AVAILABLE SERVICES AND PRODUCTS

2.1.

Subject to the Customer’s compliance with the Online Gaming Terms and Conditions herein, which must be accepted during the account registration process, Loto-Québec provides Québec residents aged 18 or older, with the opportunity to play various online games on its Website (hereinafter “Game(s)”).


2.2.

Poker, bingo, casino and lottery Games could be offered jointly and networked with other Canadian lottery corporations. This means that eligible individuals taking part in these Games through the Site could face opponents from within Québec as well as players located elsewhere in Canada.


2.3.

With regard to the “Mise-o-jeu” Game (sports betting) and any lottery draw Game in the “Lotteries” category, a purchase transaction is only concluded when it results in the registration of one or more selection(s) or play(s) in Loto-Québec’s central computer system.

In the case where a Client generates a bar code using the Site’s “Buy from a retailer” functionality, the purchase transaction must necessarily be concluded at a Loto-Québec’s retailer.

In any case, ONLY SELECTIONS OR PLAYS REGISTERED BY LOTO-QUÉBEC’S CENTRAL COMPUTER SYSTEM PARTICIPATE IN THE GAME.


3. REGULATIONS

Unless stated otherwise, the Games offered on this Site are governed by the By-law respecting interactive television games, which includes limitations of liability, as well as by the rules of the game issued by Loto-Québec.

Promotions (for example, draws or promotional tournaments) are, however, governed by the Sales promotion games By-law, which also includes limitations of liability.

As the case may be, any other directive or indication that may be specified on the Site or Portal binds the Client.


4. ELIGIBILITY AND TERMS GOVERNING USER PARTICIPATION IN GAMES

4.1.

The only individuals eligible to register on the Site and open an account on lotoquebec.com are those who are:


4.1.1.

18 years of age or older;


4.1.2.

Residents of Québec;


4.1.3.

Not currently self-excluded from Loto-Québec’s gaming halls and/or casinos, or from the Site; and


4.1.4.

Not currently subject to a ban (“denied access”) from Loto-Québec’s gaming halls and casinos.

Note that in the event that a Client is subject to a ban from Loto-Québec’s gaming halls and casinos, their account on lotoquebec.com will be automatically and irrevocably suspended for the period set out in such ban.



Registration and opening of an account on lotoquebec.com must be successfully completed before a Client can participate in any of the Games. 

Any Client who purchases tickets online, in the case of Games in the "Lotteries" category, automatically participates in one or more 2nd Chance promotion(s) insofar as it is a ticket eligible for this promotion.

Any Client who purchases, other than online, tickets eligible for a 2nd Chance promotion may participate if they have completed the fields of the account creation form indicated in paragraph 5.2.


5. REGISTRATION AND LOTOQUEBEC.COM ACCOUNT OPENING

5.1.

Any Client taking steps to open an account on lotoquebec.com is responsible for providing Loto-Québec with accurate and up-to-date personal information (full name, email address, phone number, date of birth, occupation, full mailing address, identity documents) and for immediately notifying Loto-Québec of any changes to information provided during the account on lotoquebec.com opening process.

Only a Client who has completed the creation of their account this way will be able to participate in Games (real play) and win prizes, other than within the context of a promotion or promotional offer.


5.2.

A Client may also open a non-transactional account, which only allows participation in promotions, including 2nd Chance promotions, by completing the following fields of the registration form: full name, email address, telephone number, date of birth, mailing address.

Providing this information, however, will not allow for participation in (real play) Games until the rest of the registration process has been completed.


5.3.

This information will be treated in compliance with the provisions of the Privacy Policy, particularly in order to verify, directly or through a third party, that the eligibility conditions prescribed herein are met as well as the provisions of the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and its regulations.


5.4.

Once an account on lotoquebec.com has been successfully opened according to paragraph 5.1, including the validation of their identity in accordance with the applicable terms, the registered Client becomes a lotoquebec.com member and can play by accessing their account on lotoquebec.com with a personal identification code comprised of a username or email address and of a password they created during the registration process. Only this Client is authorized to use this account and undertakes to not allow it to be used by or for another person.

Each Client has sole responsibility for preserving the confidentiality of their personal identification code. Loto-Québec shall in no case be responsible for the access or use of an account on lotoquebec.com, including cases where a Client inadvertently or otherwise divulges or loses their personal identification code in whole or in part, uses software or tools that enable automatic entry of their personal identification code in whole or in part or otherwise saves, records or writes down their personal identification code, in whole or in part, or allows access, in any way, to the email box associated with their lotoquebec.com account, if applicable.


5.5.

An individual may only open one account on lotoquebec.com. Moreover, only one name may be associated with each account on lotoquebec.com.


5.6.

Loto-Québec may, at its sole discretion and notably in case of violation of these Online Gaming Conditions, fraud, fraudulent behaviour, collusion between Clients or any other conduct deemed inappropriate by Loto-Québec, take any measure it deems appropriate, including refusing to open an account on lotoquebec.com, suspending, deactivating or closing an existing account on lotoquebec.com or, as the case may be, refusing to pay any prize.


6. MANAGEMENT OF ACCOUNT ON LOTOQUEBEC.COM

6.1. DEPOSITS TO AN ACCOUNT ON LOTOQUEBEC.COM AND PRIZE PAYMENT

6.1.1.

Many deposit methods to an account are offered, which are indicated in the “Deposit” section of the Site. Loto-Québec may, at any time and at its discretion, add or remove deposit methods. 

Loto-Québec does not however guarantee that each Client will be able to make deposits to their account on lotoquebec.com using all of these methods. The range of deposit methods available to individual Clients will depend on the banking or financial institution(s) with which they deal, as well as the operating systems used by the Client. 

Unless otherwise specified, it is not possible to make deposits to an account on lotoquebec.com using a prepaid card, a corporate credit card or an American credit card (for example, Capital One or MBNA).


6.1.2.

At no time may a Client deposit a total weekly amount (starting at midnight Sunday and ending the following Saturday at 11:59:59 p.m.) that is greater than the weekly deposit limit they set, and which is currently in effect.

The minimum weekly deposit limit is $25, and the maximum weekly deposit limit is $9,999, in whole dollar amounts only.

When a Client wishes to decrease their weekly deposit limit, the change takes effect immediately. Increases to weekly deposit limits take effect only twenty-four (24) hours after having been processed.


6.1.3.

Deposits to an account on lotoquebec.com may only be made in Canadian currency and no amount deposited or otherwise held in an account on lotoquebec.com shall bear interest.


6.1.4.

Subject to compliance with these Online Gaming Conditions, prizes won by Clients are paid directly into their account on lotoquebec.com.

In the case of the Games in the “Lotteries” category and if applicable, all free plays won following an online ticket(s) purchase are automatically issued for the draw following the one for which they were won.


6.1.5.

In view of the current situation, the claim period has been adjusted. You’ll have an additional six months to claim any prize you won with a draw-based lottery, scratch, or sports betting ticket that’s set to expire between March 17 and September 17, 2020, inclusively.

Notwithstanding any provisions to the contrary, in the event that a prize won by a Participant in the “Mise-o-jeu+” Game (sports betting) is of $100,000 or more (or any other amount determined by Loto-Québec) or in a lottery Game is of $25,000 or more (or any other amount determined by Loto-Québec) or is a “TV participation” or an “annuity”, said Client must personally go, within one year following the draw (or in the case of “Mise-o-jeu+”, within the year following the date of the last match selected of the winning selection) at a designated Loto-Québec establishment (list available upon request or at lotoquebec.com).

Loto-Québec will require that the Client show one of the following pieces of valid ID:


Once verification has been made, a cheque will be issued to the Client.


6.2. WITHDRAWALS

6.2.1.

Prior to making a withdrawal, a Client needs to link their account on lotoquebec.com to a personal bank account into which amounts withdrawn from their account on lotoquebec.com will be deposited.


6.2.2.

Unless an account on lotoquebec.com has been suspended, is subject to verification or other similar measures, withdrawals from account on lotoquebec.com may be made in the following cases:

   a. Following a request duly made by a Client;

   b. When lottery draw winnings are deposited while an account is deactivated or closed, or under self-exclusion; 

   c. When an account is deactivated or closed by Loto-Québec or the Client;

   d. Following a self-exclusion from the Site according to the provisions of Section 11 hereunder.

Except for above cases c. and d., withdrawals made to a personal bank account may not be less than $10 or any other amount as may be determined from time to time by Loto-Québec. Furthermore, for above case b., no cheque will be issued for an amount less than $20 or any other amount as may be determined from time to time by Loto-Québec. In addition, a minimum delay of 24 hours applies to requests for withdrawals from an account on lotoquebec.com.


6.2.3.

Except for withdrawal requests equal to or exceeding $100,000, amounts withdrawn from an account on lotoquebec.com will be automatically deposited to the personal bank account that is associated with the account on lotoquebec.com and for which the information will have been provided by the Client.

If the amount to be withdrawn is equal to or greater than $100,000, the Client needs to go, personally and by appointment, at a designated Loto-Québec establishment (list available upon request or at lotoquebec.com) and comply with the identification procedures described in paragraph 6.1.5.


6.3. ARGENT WEB TERMS

6.3.1.

Argent Web is deposited in the form of non-cashable gaming credits and may be used to play any game offered on lotoquebec.com. Note that in order to deposit Argent Web in their account on lotoquebec.com, the Client’s identity must first have been validated in accordance with the terms indicated on lotoquebec.com.


6.3.2.

Subject to the personal deposit limit made by the Client to their account on lotoquebec.com, a deposit limit of $500 in Argent Web, per week, per customer account, applies.


6.3.3.

An Argent Web voucher is refundable within six (6) days of purchase, from the retailer where the purchase took place.


6.4. OTHER ACCOUNT ON LOTOQUEBEC.COM PROVISIONS

6.4.1.

Clients are solely responsible for the accuracy of the information they provide in regard to transactions in their account and Loto-Québec shall in no case be held responsible for the loss or misdirection of amounts that result from inaccurate, incomplete or erroneous information provided by a Client.


6.4.2.

Under the provisions of the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, any Client may be required, from time to time, to provide additional information, including their occupation.


6.4.3.

Loto-Québec shall at no time be held responsible for delays caused by banking or financial institutions involved in the transactions. To that end, Loto-Québec provides no guarantee as to when transferred amounts may become available to a Client. Moreover, the right to such amounts is governed by the current Online Gaming Conditions and by Loto-Québec verification procedures.


6.4.4.

In case of error or technical problems with a deposit or withdrawal transaction, Loto-Québec reserves the right to make corrections by deducting or adding funds to any affected account on lotoquebec.com. Moreover, Clients hereby agree and undertake to reimburse, if necessary, all amounts owing to Loto-Québec that are the result of an error or technical problem.


6.4.5.

If a Client does not log in to their account on lotoquebec.com during an uninterrupted period of thirty-six (36) months, Loto-Québec reserves the right to close said account, in which case the account balance will be refunded in accordance with the account information on file.


7. PARTICIPATION IN GAMES

7.1. GENERAL PROVISIONS

7.1.1.

In order to access their account on lotoquebec.com and participate in Games, the Client must first enter their personal identification code in the space provided for such purpose.


7.1.2.

Only a Client who has sufficient funds in their account on lotoquebec.com to cover their bet(s) may participate in Games (real play).


7.1.3.

Clients are solely responsible for their decisions and/or provided information related to any Game and Loto-Québec shall at no time be held responsible for any decision taken by a Client or for any bet placed in error, through inadvertence or in any other similar situation.


7.1.4.

In the case of a discrepancy between data transmitted to a Client verbally, on screen or printed from a screen concerning their participation and the data recorded in Loto-Québec’s computer or in the computer of a third party designated by Loto-Québec, the latter shall prevail.


7.1.5.

Except for tournament play, a bet placed or participation to a Game while a Site or Game defect or failure exists shall not give rise to any payment or prize entitlement of any kind. However, if the defect or failure is not attributable to the Participant’s action, their bet made in such circumstances will be refunded.


7.1.6.

Moreover, Loto-Québec may decline a participation to a Game or bet for any reason whatsoever, in which case the Client is only entitled to reimbursement of the bet in question.  Without limiting the generality of the foregoing, Loto-Québec may notably establish limits regarding amounts that may be bet.


7.1.7.

Any game not completed by a Client (game in progress) could be completed or cancelled, as the case may be, in accordance with the applicable terms. Unless otherwise indicated in the corresponding Game rules, any game in progress will be cancelled after 35 days. In the event that a game in progress cannot be completed due to system modifications or other technical reasons, it will be cancelled. In the event of the cancellation of a game in progress, the corresponding bet will be charged to the Client’s account.


7.2. TOURNAMENT-SPECIFIC PROVISIONS

7.2.1.

Loto-Québec may offer Games in tournament form. In this case, instead of paying an amount for each bet, a Client wishing to take part in a tournament shall pay registration fees comprised of their contribution to the total tournament pot and a rake (commission), the whole as set by Loto-Québec. Clients are then allocated a set number of chips at the start of the tournament, to be used for betting during tournament play.


7.2.2.

Games offered in tournament form proceed, subject to the following, in accordance with the particular rules of the game.

The terms that apply to tournament mode (in particular those that apply to the number of chips, decision times and prizes) are explained in the Tournament Play section on lotoquebec.com. Moreover, the specific terms that apply to each tournament offered are made available to each Client prior to the start of the tournament, at the latest.

By participating in a tournament, each Client agrees to be bound by all of the terms that apply to it. Moreover, each Client agrees that Loto-Québec reserves the right to cancel a tournament, notably whenever it deems the number of registered Clients insufficient, or to modify it in an equitable manner for participating Clients. When a tournament is cancelled, registration fees are refunded to already registered Clients.


7.2.3.

In case of a Site failure or malfunction during a tournament, the Tournament Refund Policy shall apply.


8. POKER EXPERIENCE POINTS (PxP)

8.1.

At its discretion, Loto-Québec may offer Poker Experience Points (PxP) to any Client at such terms as it may determine. Loto-Québec may, at any time, change, suspend or cancel its offer of Poker Experience Points and related benefits in whole or in part without prior notice and without incurring liability to any and all Clients.


8.2.

Poker Experience Points (PxP) are Client-specific and may not be exchanged for cash or transferred to another account on lotoquebec.com. In addition, the closure of an account on lotoquebec.com for any reason whatsoever shall result in the cancellation of all accumulated Poker Experience Points (PxP). The same applies if a Client has not accumulated at least one (1) Poker Experience Point (PxP) during an uninterrupted period of twelve (12) months.


9. CONTENT PROVIDED BY CLIENTS

9.1.

It is forbidden for a Client to provide or transmit on or through the Site any content that is deemed to be inappropriate, including by the use of a nickname, through chat or otherwise.


9.2.

Loto-Québec reserves the right to take any measure it deems relevant in respect of any content considered inappropriate, including hateful, discriminatory, sexist, violent, offensive or other content. To this end, Loto-Québec may notably, at its sole discretion, require that a nickname be changed, remove any content deemed non-compliant or deactivate, suspend or close the account on lotoquebec.com of any Client who through chat or other means, makes any such content available.


9.3.

While various tools for verifying the Site content have been put in place, Loto-Québec provides no guarantee as to Client-provided or transmitted content and declines all responsibility for same.


10. COLLECTION AND USE OF PERSONAL INFORMATION

For the purposes hereof, personal information is that which relates to a Client and allows, directly or indirectly, to identify, locate or profile them, namely: full name, email address, telephone number, date of birth, occupation, banking information provided by the Client, political vulnerability, postal address, IP address, identity documents, photograph, geographical location, browsing and transaction history, gaming activities, username.

A Client's personal information, collected within the context of their use of the Site or their interactions with establishments of Loto-Québec, is used and/or communicated, as the case may be, for the following purposes:

 


10.1.
Advertising:
 
To publish, when a prize is won and if Loto-Québec deems it appropriate, the name, region, photograph and any other information related to the winning.
 
In this regard, no royalty for the broadcasting, printing or advertising can be claimed by a Client.

10.2.
Identification:
 
- at the registration and creation of an account, to validate identity and eligibility and to comply with its legal obligations;
- to validate the identity of a Client who communicates with Loto-Québec in order to access an account, to update it, including a password reset;
- to access a client file of a Client in order to consult and keep their communications and interactions with Loto-Québec;
- in the context of a prize claim, to administer and process the payment of prizes and carry out any verification related thereto.

10.3.
Statistics:

To produce, using depersonalized personal information, reports, dashboards, indicators, statistics and any other element of the same nature, for the purpose of improvement and organizational efficiency, marketing strategies and functional performance of the Site.

10.4.
Personalization:
 
To personalize the Client's experience, by analyzing their transactions and interactions with the various products and services on digital platforms and in Loto-Québec establishments. This information, as well as the preferences and behavioral habits of the Client constitute the customer profile, which is used to offer, in a targeted manner, products, services, promotions, promotional offers, news, advertisements, the application or the implementation of a recognition program, when applicable, measures related to responsible gaming and any other element allowing to adapt the use of Loto-Québec's products and services according to the customer profile.

10.5.
Responsible gaming:
 
For the application of responsible gaming measures, as described in article 11.

10.6.
Communications:
 
To communicate by electronic messages (emails and/or text messages) with the Client who has consented thereto, for the purpose of presenting them new products, proposing personalized offers and promotions and inviting them to give their opinion in order to improve the customer experience, in particular by participating in surveys.

10.7.
Promotions and advertisements:
 
To offer the Client personalized content on its sites and applications, promotional content, offers, news, targeted advertising and any other content of the same nature, all based on their preferences and customer profile.


When required to provide online gaming services, this information may be communicated to suppliers of Loto-Québec who are required to respect the same obligations regarding the protection of personal information. If such a supplier is located outside Québec, Loto-Québec carries out an assessment of the situation to ensure that the protection applicable there is adequate based on generally recognized principles of protection of personal information.

11. RESPONSIBLE GAMING AND SELF-EXCLUSION

11.1.
Among measures implemented to promote responsible gaming practices, Loto-Québec offers the possibility of self-exclusion from the Site:
 
a. for any individual, whether they already have an account on lotoquebec.com or not, in person at any Loto-Québec’s offices in Montreal or Québec City, or at any Loto-Québec gaming hall or casino;
 
b. for any Client, by presenting a self-exclusion request in their account on lotoquebec.com.
 
By registering for this voluntary self-exclusion program, said individual authorizes Loto-Québec, as the case may be, to prevent them from opening an account on lotoquebec.com or to block their existing account on lotoquebec.com for the duration they chose at the time of registration. In addition, a self-exclusion from the Site will automatically have the effect of suspending, if applicable, the Client's participation in the Casino Privilèges Club for the entire duration of their self-exclusion. In all cases, registration for the self-exclusion program is irrevocable.

11.2.

Moreover, if a Client self-excludes from Loto-Québec’s gaming halls and/or casinos, this self-exclusion will automatically have the effect of blocking their account on lotoquebec.com, and this, irrevocably and for the duration chosen at the time of registration in the self-exclusion program.


11.3.

Loto-Québec assumes no responsibility if a Client contravenes in any way whatsoever the ban (self-exclusion) to which they have voluntarily committed.


11.4.
To promote the adoption of healthy gaming behaviors, Loto-Québec wishes to provide the Client with relevant information and tools to support them. To this end, Loto-Québec may, depending on the customer profile, offer the Client awareness and prevention content based on their habits.
 
An analysis of the customer profile performed with the assistance of an algorithm, which could be used with artificial intelligence, allows the personalization of the Client’s experience in accordance with appropriate responsible gaming practices. Based on the information of the customer profile and this analysis, Loto-Québec can provide the Client with information aimed at promoting healthy gaming behaviors, modifying the content or frequency of personalization of the Client's experience, or even limiting interactions with its products and services. Information relating to gaming behavior is accessible to the Client in their account.

12. LIMITED LIABILITY

12.1.

In addition to the other limitations of liability contained herein and in Loto-Québec’s General Conditions, in the By-law respecting interactive television games, the By-Law respecting forecast contests and numbers games, the By-law respecting casino games, the By-law respecting the Mini Loto, any instant lottery, and any "pool" type lottery, the Rules and Regulations Respecting Lotteries and Lottery Tickets of the Interprovincial Lottery Corporation (available upon request), and/or in the Sales promotion games By-law or in any other applicable text, Loto-Québec, its administrators, employees or agents shall not be held in any way responsible under civil law or otherwise for any damages or losses of any kind whatsoever related to the browsing, use or participation in Games on the Site or for the inability to access or use the Site, including in case of: (i) failure, defect or destruction of information systems used in relation with the Games offered on the Site; (ii) delays or lateness, however caused, which preclude anyone from opening or accessing an account on lotoquebec.com, participating in Games or placing a wager in a timely manner in a Game; (iii) use of outdated browsers, combinations of different browsers or failure to update the electronic devices used; (iv) similarly due to any failure, delay or other like circumstances attributable to third parties involved in the provision of services, including banking and financial institutions and suppliers of telecommunication services or equipment.


12.2.
The Client understands and agrees that Loto-Québec may, at any time and at its sole discretion, cease to offer Games on the Site and withdraw or add Games without incurring any liability on its part, except in the event of a permanent withdrawal of a Game offering a progressive jackpot, in which case any amount collected from eligible bets for the purposes of said progressive jackpot will be redistributed to players in the manner deemed appropriate by Loto-Québec.
 
Moreover, Loto-Québec shall not be held liable if it decides to decline the creation of an account on lotoquebec.com, to deactivate it, block it, suspend it or close it, or takes any other measure it deems appropriate due to non-respect of these Online Gaming Conditions or for any other reason it deems relevant, and may proceed to any verification of any disputed or suspicious situations.

POLICY CONCERNING PRIVACY AND THE PROTECTION OF THE PERSONAL INFORMATION

Loto-Québec strives to respect and safeguard the privacy of each User of its Web sites. This policy was developed to inform all Users about Loto-Québec’s commitment to this effect. Moreover, the terms as defined in the Conditions of Use also apply to this policy. 

This policy governs the content and operation of the Portal, as well as each User’s authorized use of the Portal. 

Users accept that this policy may be modified by Loto-Québec at any time and without prior notice and to be bound by such modifications. Therefore, it is recommended that Users consult this policy regularly in order to remain apprised of its applicable terms. The specifics of the policy are as follows:


1. PERSONAL INFORMATION

1.1. Collection

The Web portal does not include any technology that could be used to collect personal information from the User without his or her consent. Users are free to use the Portal, subject to the terms contained in the General conditions governing the use of the Internet sites operated by Loto-Québec and its subsidiaries and, where applicable, to the Espacejeux Specific Conditions of Use without their personal information being collected. 

No personal information is collected without User’s prior consent. The only personal information that Loto-Québec may collect is information that is provided voluntarily by the User when writing directly to an email address found on the Portal, participating in a promotion, registering for a service, opening an account, or by other similar means. In order to be able to provide the requested service, open an account or comply with legal requirements, Loto-Québec reserves the right to request personal information or supporting documents from the User.

1.2. Use

Personal information is treated and kept in the same manner as any other direct exchanges between Loto-Québec and its customers (by mail, telephone, etc.), that is to say, in accordance with the provisions of the Act respecting Access to documents held by public bodies and the Protection of personal information, R.S.Q., c. A 2.1.
